Things to Know About the Wrongful Death Claims Process

Experiencing the loss of a family member is one of the most painful and devastating aspects of life. The difficulty of this loss is often compounded when the individual’s life is taken due to circumstances occurring from someone else’s negligence, like a motor vehicle collision. In these matters, it may be deemed wrongful death, indicating that the decedent should not have lost their life and their death was the result of another party’s negligence or carelessness. According to California law, eligible surviving family members may seek reimbursement of losses through a wrongful death action.

It is essential to recognize that the wrongful death claims process may be challenging to navigate alone as it involves specific procedures. When filing a claim, surviving family members have the opportunity to seek justice and financial compensation for various losses. This may include the loss of inheritance, funeral costs, medical bills (via survival action), loss of companionship, loss of services, deprivation of financial support, and more. In the case of a hit-and-run fatality and the facts involved, eligible survivors may seek reimbursement for the associated losses through uninsured motorist coverage.

Navigating the statute of limitations in California can be complex. A wrongful death case must be filed within a specific time frame. Typically, the limit is two years from the individual’s death, but there are instances where this period can be extended. An experienced wrongful death lawyer can assist in understanding your options as a surviving family member. It is advisable to consult with an attorney sooner rather than later to ensure the best course of action and that the case is filed on time. Missing the deadline may result in the loss of the right to recover compensatory damages.
