What is Wrongful Death?

The loss of a loved one due to an accident may be emotionally and financially devastating. The loss of life may be deemed wrongful death if it occurred because of recklessness or negligence. The purpose of a wrongful death action is to compensate surviving family members for their financial and intangible losses. In a motor vehicle collision fatality case, the insurer representing the negligent party typically covers damages. If the other side does not have insurance or has insufficient coverage, survivors may have grounds for a claim through uninsured and underinsured motorist coverage.

Importance of Working With a Wrongful Death Attorney

Without a doubt, surviving family members have many concerns to address following the loss of a close relative. However, the importance of reaching out to a lawyer immediately after the following incident cannot be overstated. An attorney can handle all aspects of the case so survivors can shift their focus onto other matters. An experienced lawyer can handle communications with involved parties, collect evidence that is time-sensitive and still available, build a strong case, ensure that all deadlines are met, and negotiate with insurers and defense counsel.

Selecting the right lawyer may make a significant difference in the outcome of a wrongful death auto accident case. When searching for legal representation for such a complex and sensitive matter, it is crucial to ensure that the attorney you choose has years of experience handling cases like yours and has the resources to handle the challenges that may arise in the matter. It is helpful to work with a law firm that has a history of satisfied client reviews, awards and recognitions demonstrating their standing in the legal community, and a history of successful case results.

The California wrongful death lawyer you select will be your advocate during a difficult time. Therefore, it is essential to take the time to ask questions, research, and ensure that you are making a well-informed decision. It is essential to note that a strict filing deadline applies to these cases. Most are subject to a time limit of two years with the exception of matters involving public agencies. Under those circumstances, the two-year statute of limitations is decreased to six months. Filing deadlines and criteria are some of the many reasons why it is important to hire an attorney to handle your case.
