Losing a Close Relative in a Wrongful Death Car Accident

A catastrophic car accident may have tragic and lasting consequences for all parties involved. In some extreme cases, they may even result in fatal injuries. When this happens, the family left behind may be met with overwhelming shock and grief about what the future may hold for them. What is most unfortunate is that they must deal with legal and financial matters instead of taking the time they need to take care of one another and grieve.

The loss of a loved one in a motor vehicle crash is both financially burdensome and emotionally traumatic. Fortunately, surviving family members may have the right to hold the negligent party liable through a wrongful death claim. This is a type of civil case in which survivors may seek compensation for losses incurred from the at-fault party and their insurance company.

While no amount of money can undo the pain nor bring a lost loved one back, a wrongful death car accident case can help a family obtain the justice and compensation they need. However, such cases are best left to experienced attorneys to handle. For information on how to find the best Stockton wrongful death lawyer, watch the video below.

What is the Filing Deadline for a Wrongful Death Lawsuit in California?

A wrongful death claim must adhere to a strict filing deadline known as the statute of limitations. Under the California Code of Civil Procedure Section 335.1, a claimant has two years to file in civil court. This means that surviving family members only have two years from the date of the fatal incident to collect evidence, retain a lawyer, and begin the claims process.

If survivors delay taking legal action past the two-year deadline, the court may dismiss their case, and they may lose the right to recovery of damages incurred.
