What is a Wrongful Death Action?

A wrongful death claim is a civil case brought by the survivors of the deceased, as specified in the California Code of Civil Procedure 377.60. The purpose of a claim for wrongful death is to seek damages from the party or entity that caused the incident and the loss of life. Damages may vary from case to case due to the unique facts and circumstances involved. In most cases, eligible survivors may be compensated for non-economic and economic damages. These may include funeral costs, burial expenses, mental anguish, loss of financial support, medical bills (through a survival action), and other associated losses.

There is a time limit of two years for cases of wrongful death in the state of California. Keep in mind that quick action is necessary in these matters. Evidence must be gathered and preserved before it disappears as time progresses. Moreover, witness accounts of the incident may fade over time. The sooner that legal counsel is retained, the better. An attorney will work quickly to conduct an in-depth investigation, identify negligent parties, and work with insurers and defense counsel toward a resolution. If unsuccessful, the right attorney will have the experience necessary to take the case to court.

Commercial Truck Accident Cases Involving Hit-and-Run Drivers

Hit-and-run accidents involving large commercial trucks are not uncommon. There may be a wide array of reasons why a truck driver who was involved in a crash may have left the scene of the incident. Some of these may include failing to realize they were involved in an accident (due to the overwhelming size and weight of the big rig), distracted driving, DUI, and other reasons. Despite the actions of the truck driver, injured parties or survivors may be eligible to seek financial compensation for their damages with the right assistance.

Retaining legal counsel is recommended in personal injury or wrongful death cases involving big rigs. An attorney will work with a private investigator to locate the large commercial truck involved in the hit-and-run accident.
