What is Wrongful Death and What Damages Can Be Recovered?
A wrongful death may occur for a wide array of reasons. A motor vehicle collision is a common reason for fatalities. Such crashes may occur because of driver negligence. An example is a driver heading down the road, and their car is struck by a big rig. If the collision is severe and the resulting injuries lead to an individual’s death, the truck driver and trucking company may be held liable for losses incurred. Other parties may be responsible for a commercial truck accident. It will require an independent investigation of the incident to determine which other parties may be held liable for resulting damages.
To bring a successful wrongful death claim forward, it must be proven that a family suffered economic and non-economic damages due to the unexpected loss of a loved one. An accident attorney can help surviving family members by assessing the value of each damage to seek maximum compensation. A family may be eligible to seek financial losses, such as lost benefits, out-of-pocket expenses, funeral service costs, end-of-life medical care expenses, lost financial support, lost income, and more. Some intangible losses that a lawyer may recover may include mental anguish and loss of companionship, care, and protection.
