Loss of a Child in a Bicycle Accident

Every parent’s worst nightmare is losing a child in an accident. The pain and devastation from the loss may be unbearable, particularly if it occurred because of another party or entity’s negligence. California law recognizes this and provides the parents or legal guardians of the deceased child to take legal action against the at-fault party in the form of a wrongful death action. In the case of a fatal bicycle accident, a claim may be brought against the negligent driver and their insurance company. When there are concerns on whether the negligent driver has liability coverage or sufficient policy limits, a family may turn to their auto insurance policy if they have uninsured and underinsured motorist coverage to pay for damages incurred.

The unfortunate reality is that some insurance companies, including your own, may not be willing to make things right for a family of a deceased minor child by making the claims process straightforward for them. That is because insurers are focused on protecting their bottom lines, and that often comes at the expense of surviving family members as they will resort to any defense tactic to get out of paying a wrongful death claim. This may include pinpointing liability on the decedent, often making matters worse for survivors who are working on coming to terms with the unexpected loss. Given that California follows a system of comparative fault, this may reduce the amount of compensation awarded to the family for their loss. That is where the assistance of an experienced Concord wrongful death lawyer may make all the difference.

A skilled attorney knows all too well that drivers must exercise a greater duty of care when there are children present in the area, and the failure to uphold that obligation may constitute negligence. A lawyer may also work with experts in the field to conduct an independent investigation of the bicycle accident to properly determine fault. This way, the attorney can establish negligence on the part of the other side and seek compensatory damages on behalf of surviving family members. The claims process may be an uphill battle, but with the right lawyer protecting your rights and interests as a survivor, you can rest assured knowing that your case is in good hands.
