What is a Wrongful Death Claim?

When an individual suffers fatal injuries in a car versus bicycle collision caused by a negligent driver or entity, survivors may have a wrongful death claim. Examples of negligence that may lead to a fatal bicycle accident and wrongful death claim may include but are not limited to distracted driving, speeding, not yielding the right-of-way to cyclists, DUI, and other negligent actions behind the wheel.

The specific economic and non-economic damages vary with each wrongful death claim. Common losses recovered by the surviving family members of decedents in California may include costs of medical care the deceased incurred before they passed away, final resting bills, loss of the loved one’s future earnings, loss of companionship, mental anguish, and more.

Specific relatives are allowed to file a claim for wrongful death in California. Those with priority for filing such matters include the children, domestic partner, or spouse. If the decedent was not married, did not have a domestic partner, or had no children, their surviving stepchildren, parents, putative spouse, and other relatives who depended on them for financial support may be eligible to file a claim for damages.

How Much Time Do You Have to File for Wrongful Death?

The California Code of Civil Procedure Section 335.1 defines a statute of limitations as two years past the date of loss to file a wrongful death action in civil court. This must be followed if a mutual settlement agreement is not reached with the other side within that period. Therefore, it is essential to retain legal counsel immediately.
