Seeking Compensation in a Fatal Car Versus Bicycle Accident Case

A wrongful death action may arise when an individual suffers fatal injuries in an accident caused by someone else’s negligence. These types of cases are intended to compensate survivors or other family members who were financially dependent on the decedent. Cases for wrongful death are solely filed to seek reimbursement for the loss of life, including economic and non-economic damages. Eligible close relatives with priority for filing generally include the spouse, domestic partner, or children. Other relatives may be eligible for filing based on the facts of the case and the criteria set forth in CCP 377.60.

Economic and non-economic damages in a wrongful death case are those suffered by the surviving family members or dependents of the deceased. These may include losses such as loss of benefits to the decedent’s dependents, loss of care, affection, and companionship, lost wages and benefits the deceased would have earned if not for the fatal incident, funeral and burial service costs, and more. In the case of a car versus bicycle accident, a wrongful death claim may be brought against the at-fault party and their insurance company.

Punitive damages in California are limited and specific conditions must be met for a claim to be considered. For instance, if an at-fault party was driving under the influence or excessively speeding in the time leading up to a bicycle accident, punitive damages may be sought from them to punish them for their egregious conduct.
