Bilby Road Elk Grove Fatality Accident May Have Involved Speed
A young Elk Grove driver lost their life in an Elk Grove accident on August 27. The collision occurred along westbound Bilby Road around 12:44 a.m. The driver was reportedly speeding, according to the Elk Grove Police Department, before they struck a curb, which caused them to crash into a tree.
Investigation Underway to Determine Cause of Elk Grove Fatality Accident
Whether drugs or alcohol factored into the fatal accident is unknown. The police department requests that those with information about the accident call (916) 478-8148. The County Coroner’s Office will release the deceased’s name when the family has been notified.
Speeding and Auto Accidents
Speeding is a common cause of an Elk Grove fatality accident. However, it isn’t the only cause. Sudden unintended acceleration can occur for several reasons, the main one being a defect in the vehicle itself. An electronic malfunction, design flaw, some mechanical failures, and others can cause a vehicle to accelerate out of the driver’s control.
Keeping a vehicle following an Elk Grove fatality accident is essential. An automotive engineer can carefully examine the vehicle to determine if a defect in the car caused the collision. If it did, the family may claim auto product liability against the manufacturing company, designer, and others.
Lack of Roadway Maintenance
Poor roadway maintenance can also lead to an Elk Grove fatality accident, causing the driver to lose control or overcorrect. For example, a pothole, an object in the roadway, and upheavals or fissures in the pavement can cause this type of accident. When roadway maintenance is lacking and causes a collision, the government agency in charge may be liable for injuries or fatalities. However, the statute of limitations for government claims is only six months. Getting help from an injury lawyer to avoid missing that deadline might be practical. The court will not hear the case if the paperwork is filed too late.
Filing a Wrongful Death Claim
If negligence is found to have caused an Elk Grove fatality accident, the deceased’s immediate family members have the right to file a wrongful death claim. By doing so, they may recover the following in damages, although recoverable compensation varies from case to case when filing a claim for wrongful death:
- The cost of the funeral and burial
- Wages and other bonuses of the job until retirement age
- Spouses may claim loss of consortium, love, and affection
- Children may claim compensation for the loss of a parent
- Loss of household assistance
