In a press release by CHP traffic officers, the incident involved a green Toyota Camry and a Toyota 4Runner. The Toyota Camry reportedly sustained major driver’s side damage, while the Toyota 4Runner was left with major front-end damage after the collision.

Things You Should Know About Car Crashes and Wrongful Death Claims

After the unexpected loss of a loved one, the lives of surviving family members may come crashing down on them. Anger, confusion, and disbelief may overwhelm survivors. While nothing may bring a loved one back or undo the pain the sudden loss has caused, a wrongful death claim may serve to hold the at-fault party financially accountable for the wrongful death and damages incurred. What families should keep in mind is that the claims process is not straightforward, and insurance companies do not always have their best interests at heart like they claim to do.

The goal of a wrongful death claim is to provide those who depended on the decedent for financial support with the means necessary in establishing a more secure future. It also serves to compensate them for the intangible losses they have experienced. Another objective of bringing a claim for a fatal car accident is to provide surviving family members with much needed closure. Seeking compensation from the insurance company is often challenging as insurers are focused on protecting their bottom line. What is most unfortunate is that such situations also play out in first-party insurance claims under uninsured and underinsured motorist coverage.

By assisting survivors in navigating the legal process, a lawyer can help them obtain a sense of justice which is critical in the healing process. To learn how to find the best attorney in your area to handle your case, watch the video below.

Types of Wrongful Death Compensation Available to Survivors

Surviving family members may seek the economic and non-economic damages related to the loss of their loved one through a wrongful death claim, according to California. This would be compensation for the financial losses and intangible aspects of life in which must be established through compelling evidence and expert witness testimony. This may include:

  • Costs of medical treatment and funeral services related to the wrongful death of a loved one
  • Lost future financial support, which may include what the decedent would have expected to earn if not for the fatal car accident
  • Loss of protection, companionship, and care the loved one would have provided to survivors
  • Mental anguish resulting from the unexpected loss of a close relative in a motor vehicle collision
