Driver Arrested for DUI After Rollover in Fresno

Officers from the Fresno Police Department (Fresno PD) arrested a driver for felony DUI after a rollover collision in northeast Fresno on the night of Monday, October 19, 2020. A preliminary investigation by Fresno PD revealed that four men were in a Chevrolet Cruze sedan traveling westbound on Ashlan Avenue in the vicinity of Angus Street at approximately 10:30 p.m. The Chevrolet driver was reportedly speeding moments before striking a parked vehicle, causing his car to overturn on impact.

Authorities said the driver and two of three passengers were able to exit the vehicle, but a third passenger was pinned inside. Crews from the Fresno Fire Department were called to the scene to help extricate the man out of the vehicle. He was transported to a hospital for treatment of his injuries and is expected to make a recovery. Further details about the car accident were not immediately available.

Proving Liability in a Rollover Accident

When a rollover accident involves one vehicle, liability may be clear in some instances. The incident may have been the result of driving under the influence, texting while driving, and other negligent actions while behind the wheel. However, other factors may play a role in rollover accidents. Road defects are often to blame for rollovers due to potholes, poorly designed roads, malfunctioning or missing road signs, and more. In such situations, the government entity responsible for the upkeep of the road may be held financially liable for losses incurred. In other cases, an automaker may be found at-fault for exacerbation of catastrophic injuries or wrongful death when the roof of the vehicle involved in the rollover has failed to meet safety guidelines. This is possible so long as a Fresno car accident lawyer can prove that the roof of the car has failed to meet Federal Motor Vehicle Safety Standard 216 on roof crush resistance.
