Pedestrian Identity to Be Released Following Fatal Davis Highway Collision

After being initially struck, the pedestrian ended up in the lane on the far left-hand side, where another vehicle struck them. The pedestrian died at the accident scene. The Yolo County Coroner’s Office will release their identity once the next of kin has been notified.

Ongoing Investigation Into Fatal Pedestrian Accident

The motorists who struck the person on foot stayed at the Davis highway collision scene. The CHP reported that neither alcohol nor drugs factored into the cause of the accident. The investigation into the crash is ongoing, and those with information are asked to call (530) 702-6250, which is the Woodland office of the CHP traffic accident unit.

Recovering Wrongful Death Compensation

When a pedestrian dies in a Davis highway collision, it must be determined that negligence by a motorist or entity was responsible for the fatality for the spouse and children of the deceased to file a wrongful death claim. An accident injury lawyer often has the resources and investigators to determine this. By conducting an investigation into the factors involved in the crash, such as:

  • The investigators will visit the accident scene to take photos and search for surveillance cameras that may have captured the accident on film.
  • The report filed by the police is examined for evidence of driver negligence and citations that were issued. It is also checked for accuracy since errors could affect the wrongful death claim.
  • Accident reconstruction may be performed, which shows the positions of the pedestrian in relation to the vehicles.
  • Interviews are conducted with the witnesses to the accident. In some instances, it might have been captured on a cell phone as it occurred.
  • The firm’s attorneys analyze the gathered evidence and use it to build a strong case for the client.

Compensation That Can Be Recovered in a Wrongful Death

The following areas are commonly compensated in a wrongful death claim:

  • Earnings from the job the decedent held are recovered, and repayment for their lost benefits, such as insurance and pension, is offered until the age of retirement.
  • The expenses for the funeral, cremation or burial are recovered.
  • Compensation for the spouse’s loss of consortium, moral support and affection is recoverable.
  • The family’s children can claim payment for their loss or parental guidance and nurturing.
  • Household support the decedent provided is recoverable, such as taking care of the lawn, doing the taxes, cooking, cleaning and others.
