Crash Fatally Injures Two Sacramento Men

I’m Ed Smith, a Sacramento Wrongful Death Lawyer. On May 18, 2017, a car accident, occurring in Live Oak, just north of Yuba City, killed two people during a head-on collision on Highway 99. My heart and prayers go out to the families and friends of all involved in this tragic event.

What Happened

After visiting his friends, a Sacramento man was traveling home on Highway 99 in a Chevrolet Silverado. Early reports indicate he failed to turn during a curve near Lomo Crossing and his vehicle crossed the line into oncoming traffic. He struck a Dodge Neon head-on, being driven by a 60 to 70-year-old-man. The Silverado then pushed the Neon back, smashing it into the side guard rail. The Silverado continued, flipping over and ending on its roof, ejecting the man from the car in the process. Sadly, both drivers passed away at the scene. It was reported that neither driver was using a seatbelt at the time of the accident.

The California Highway Patrol suspects that the Sacramento man who was behind the wheel of the truck was driving under the influence of drugs and alcohol at the time of the crash. A friend of the man driving the Silverado reported that he was seen drinking earlier the same evening. Officers reported finding alcohol containers in the truck. Additionally, the truck reportedly caught fire.

Fatal DUI Statistics

The CDC shares the following statistics for the state of California about deaths with alcohol involvement. The legal limit of alcohol in the blood is to be under 0.08%. Any amount of 0.08% or greater is illegal to be driving under the influence.

  • From 2003 to 2012 over 10,327 people  suffered fatal injuries from an accident involving an alcohol-impaired driver.
  • The age group including 21 to 34-year-olds have the highest rate of drunk driving fatalities per 100,000 people of all age groups.
  • In California, 1.8% of adults report operating a vehicle after drinking too much within the last 30 days
  • In 2013 alone, there were 160,388 DUI arrests in the state of California according to the DMV.
  • At least 892 fatal accidents involved drug impairment in 2013

Driving under the influence: Drugs and Alcohol

When referencing a DUI, it is easy to assume that the incident involves alcohol, but this isn’t always the case. Drugs can also severely impair one’s ability to drive. Driving under the influence of marijuana is another area that is gaining in notoriety due to the increase in the number of states that are legalizing its use for recreational purposes. Driving while under the influence of marijuana hinders one’s ability to drive and is illegal in all 50 states. Read “Too High to Drive” to learn more.
