Crash Fatally Injures Teenager Near Merced County

I’m Ed Smith, a Merced personal injury lawyer. A rollover accident occurred near Merced County on the late afternoon of Wednesday, September 27, 2017. The collision, unfortunately, claimed the life of a teenager.

We would like to extend our thoughts and condolences to the loved ones of the young woman that passed away in this devastating car accident.

What Happened?

A 20-year-old Merced man was driving his 2005 Honda Civic northbound along Highway 99 at approximately 5:50 pm. For unknown reasons, the driver lost control of his vehicle in the area of Buchanan Hollow Road and Silveira Way. The vehicle veered towards the right shoulder and overturned several times. The impact of the collision trapped the driver along with his passenger inside the vehicle.

Were They Injured?

Emergency personnel arrived at the scene to extricate the two occupants of the Honda. The driver suffered unspecified injuries and was transported to the hospital for treatment. The passenger, identified as a 19-year-old Chowchilla woman, suffered fatal injuries at the scene.

What Caused the Accident?

The California Highway Patrol (CHP) has been appointed to handle the accident investigation. A Traffic Collision Report is generally processed within two weeks. Authorities do not suspect alcohol or drugs to have contributed to the collision. It is wise to contact a qualified accident lawyer to conduct an independent investigation into the cause of the accident to properly determine fault in a collision. If a motorist was negligent and contributed to the death of another invidual a claim can be filed for damages and/or wrongful death. Contact an attorney for more information.

Automobile Accidents Involving Passengers

Passengers, like drivers, have rights in automobile accident cases. Passengers are entitled to be compensated for the full amount of their losses. For example, if another vehicle collides with the car carrying a passenger, the passenger may file a claim against the automobile insurance policy of the at-fault party. If the at-fault party does not have insurance and/or has minimal policy limits, there may be an alternate route for compensation. If the vehicle the passenger was riding in has Uninsured/Under-insured Motorist Protection (UM), the passenger may file a claim against that policy. In such occurrences, a passenger may retrieve full compensation for their losses, or at least the maximum insurance policy limits amount depending on the extent of their damages.
