What to Know About the Claims Process After a Car Accident

A car accident may be stressful and overwhelming, to say the least. In addition to property damage, you may be dealing with injuries, mounting medical bills, and lost income from missing work to recover or attend doctor’s appointments. Emotional trauma and physical pain may also weigh on you and your loved ones. The last thing you should be thinking about is dealing with difficult insurers. However, it is crucial to understand how your personal injury claim will be handled by the insurance carrier when the time comes to filing one.

The insurance company representing the at-fault party may conduct an investigation immediately following the motor vehicle accident. It is essential to understand that this is often done by insurance adjusters to minimize the value of bodily injury claims filed against their insured. What is most unfortunate is that these tactics may also be used in first-party insurance claims brought under uninsured motorist coverage or underinsured motorist coverage. It is also not uncommon for some claims adjusters to reach out to injured parties to request a recorded statement. This is one of the many defense tactics insurers use to gain unfair advantages over claimants with respect to the severity of their injuries. What we should all understand is that injuries may not immediately manifest until days or even weeks following a traffic collision.

With this information in mind, it is often rare for an insurance carrier to ever agree to make a fair settlement offer for a car accident. As such, claimants should be prepared to undergo negotiations with the insurer when working toward a fair financial recovery to move forward from the crash. If the insurance company is not willing to pay fair compensation on a bodily injury claim, filing a lawsuit in civil court may be the only avenue to not only obtain a favorable outcome but also protect the two-year statute of limitations for personal injury cases.
