Details on the Atwater-Merced Expressway Car Crash

A preliminary report by CHP traffic officials revealed that the traffic collision prompted the response of the Riggs Ambulance Service. One of the vehicles involved in the crash, a black Ford Fusion, was found with major front-end damage on the right-hand side of Highway 99. Additional information on the incident, including what caused it and the number of people who were injured, was not immediately available.

What You Should Know About the Insurance Claims Process for a Car Accident

Under California, the party responsible for causing a traffic collision is liable for covering damages incurred. The process generally involves the insurance company representing the at-fault party paying for damages up to the limits of their policy. Compensation after a motor vehicle collision will depend on a wide array of factors, including the number of parties involved in the incident and the negligent driver’s coverage limits for bodily injury. In situations where the other party does not have enough liability coverage, an injured party may seek recourse through the underinsured motorist portion of their insurance plan. Conversely, when the at-fault party does not have liability insurance, uninsured motorist may come into play.

Do not agree to a recorded statement or accept a settlement offer from the insurance company, including your own, without discussing your case with an experienced Merced personal injury lawyer. During the claims process, the main goal of the insurer is to protect their bottom line and will do so by not paying a fair amount for your injuries and damages incurred. Any initial settlement offer from the insurance carrier may be significantly less than what your personal injury case is truly worth. The unfortunate reality is that it may not account for past and future bills for medical treatment, lost income, loss of future earnings, pain and suffering, and other accident-related losses. Agreeing to the first offer an insurance company makes may cause a negative impact on your future.

Before speaking with the insurance company, it is crucial to go over the facts and circumstances of your case with an experienced injury lawyer. Unlike the insurer, you can trust the evaluation an accident attorney may provide you as they will have your best interests at heart and will want to determine your best course of action moving forward. Keep in mind that you generally have two years to bring a lawsuit in civil court if the insurer is not offering as much as your losses and injuries are actually worth. This is by the California Code of Civil Procedure Section 335.1. Therefore, retaining legal counsel right away is necessary in protecting your right to fair compensation in such situations.
