What Should You Do Immediately After a Car Accident?

California has laws in place that require parties involved in crashes to stop and remain at the scene, particularly if the incident involves injury, property damage, or death. When a driver fails to stay at the scene to identify themselves, they may be charged with a misdemeanor or a felony for hit-and-run, depending on the circumstances of the car accident. The ability to seek compensation for losses resulting from a crash may be impacted by the failure to stop and exchange information. To ensure that any personal injury claim you may have after a traffic collision remains viable, it is a good idea to follow these steps:

  • Immediate Safety: If you were involved in a car accident on Highway 99 or another busy roadway, it is essential to move your vehicle to a safe location that is near the incident scene that does not impose a hazard for oncoming vehicles.
  • Report the Accident: Contact local law enforcement to have responding officers take a traffic incident report at the scene. Be sure to check yourself, your passengers, and other parties involved in the motor vehicle crash for injuries. If anyone was injured, call 911 for an ambulance to be requested at the scene. Remember to report the crash to your insurer and keep the details to a minimum. If the claims adjuster requests a recorded statement or signature for documents, politely decline and refer them to your accident attorney if you have one.
  • Collect Evidence: Evidence plays a key role in establishing the sequence of events leading up to a car accident and who was responsible for it. That is why it is recommended to take pictures and videos of the incident site, if possible. Ideally, try to capture the license plates of all involved vehicles, damage to the cars, the position of the vehicles on the road, skid marks, and roadway signage.
  • Schedule Follow-Up Treatment: Regardless of whether or not you were assessed by first responders at the scene, it is essential to seek treatment immediately after the car accident, even if you believe your injuries are minor. There are some serious injuries that may not present themselves right away, like a traumatic brain injury. That is why it is recommended to get treated right away to establish medical documentation of your injuries that link them to the crash.
