Financial Recovery for a Car Accident Caused by a DUI Driver

Getting injured in a motor vehicle collision through no fault of your own can be traumatic and life-changing. It may be even more stressful to overcome if the motorist who caused the car wreck was under the influence of alcohol or drugs. If a recent auto accident has left you struggling to recover and unsure of how to proceed in your situation, you need all the support you can get – physically, emotionally, and financially. Filing a bodily injury claim against the at-fault party and their insurance company is essential to obtaining the financial recovery you need to get your life back on track.

Eligible claimants may seek reimbursement for economic and non-economic damages in an injury case. These generally include pain and suffering, wage loss, medical costs, and other losses in connection with the incident and the resulting injuries. If a motor vehicle collision causes injury to more than one party, there may be a concern regarding liability coverage limits for claimants. When in such situations, it is helpful to fall back on your uninsured and underinsured motorist coverage. This will help pay for losses not covered by the other side up to the plan’s limits.

In addition to economic and non-economic damages, an individual injured in a drunk driving accident caused by another party may be able to seek punitive or exemplary damages. The purpose of punitive damages is to punish the individual who acted egregiously without consideration for the consequences of their actions. Exemplary damages serve to hold the other side accountable. It also deters them from similar conduct in the future. In the case of a DUI crash, it is intended to make an example out of the driver that their egregious behavior will not be tolerated.

How Much Time Do You Have to File an Injury Case?

A statute of limitations is the amount of time you have to file a lawsuit in court. Failure to do so may result in the loss of the right to take legal action. In most cases of personal injury, claimants generally have up to two years to file. This is by the California Code of Civil Procedure Section 335.1. Exceptions may apply under specific circumstances. For assistance with your case, it is recommended to retain legal counsel immediately.
