Boat Trailer Fatally Injures Bicyclist Near Manteca

I’m Ed Smith, a Manteca wrongful death attorney. A bicyclist suffered fatal injuries after reportedly colliding with a boat trailer along East Yosemite Avenue and the northbound Highway 99 on-ramp on Sunday, April 22, 2018. The bicycle accident occurred shortly before 11:00 am when the bicyclist, for unknown reasons, rode directly into the rear of a pickup truck hauling a boat trailer and fell underneath the trailer’s wheels. Emergency crews responded to the scene to jack up the boat trailer by placing blocks underneath to extricate the victim and provide life-saving measures. Unfortunately, their efforts were unsuccessful, and the bicyclist was pronounced deceased at the scene. The San Joaquin County Coroner’s Office has identified the victim as 46-year-old Tammie Leandro of Manteca.

Our sympathies go out to the friends and family mourning the loss of their loved one.

Bicycle Accidents

When a bicyclist is involved in an accident with a motor vehicle, they are likely to suffer serious injuries due to their lack of physical protection. A bicycle accident may cause someone to have the following injuries:

  • Bone fractures in a bicyclist’s arms, hands, legs or feet;
  • Brain injury can cause partial or complete impairments in a person’s mental functions, which can be life-long and devastating for the sufferer and their family;
  • Bruises and internal injuries or internal bleeding;
  • Crush injuries which can lead to loss of limbs or amputations if a body part becomes crushed or pressed between two surfaces;
  • Open wounds may cause infections due to foreign substances entering the body;
  • Liver damage;
  • Scrapes, lacerations, cuts or road rash;
  • Spinal cord trauma;
  • Spleen injuries;
  • Wrongful death.

What is Wrongful Death?

In California, a wrongful death means that an individual passed away as a result of another party’s negligence or unlawful act. A wrongful death claim may be presented by the family of the decedent in a civil court. If an investigation finds an individual or entity responsible for the death of the person, specific members related to the deceased under California Code of Civil Procedure 377.60 may bring a wrongful death action to recover financial damages.

Recovering Damages from a Wrongful Death Lawsuit

Following are some of the damages that can be recovered in a wrongful death claim:

  • Benefits lost such as retirement the person would have collected;
  • Burial and funeral cost;
  • Emotional distress and mental anguish the death caused;
  • Loss of inheritance, future earnings and support the family would have received from the decedent.

A wrongful death claim must be filed within the statute of limitations, which is two years from the time of death in California. If you have lost someone you love as a result of another party’s negligence, it is essential to contact an experienced wrongful death lawyer in Manteca. An experienced attorney can go over the details of your loss and decide the best way to proceed.
