What Should Be Expected From a Commercial Truck Accident Case?

A big rig crash may cause severe harm to all parties involved, including those in passenger vehicles, on foot, or riding bicycles. Injuries from a truck accident may require extensive rehabilitation and treatment. In some extreme cases, an individual may succumb to crash-related injuries. State and federal regulations overseeing the trucking industry are in place to maintain the safety of all parties on the roadway. When a truck driver or trucking company fails to follow federal or state regulations, and a collision occurs, an injured party or surviving family member may have grounds for a claim for damages.

One of the first steps in navigating a wrongful death or personal injury case for a tractor-trailer collision is determining what caused the incident. An experienced California truck accident lawyer can investigate the cause of the big rig crash and build a solid case to help their client obtain full compensation for their non-economic and economic damages. Some of the most common reasons for 18-wheeler wrecks include uninspected trucks, poorly maintained big rigs, distracted driving, overloaded semi-trucks, driving while fatigued or drowsy, failure to yield the right-of-way, speeding, DUI, etc.

No matter the severity of injuries and losses from a big rig crash, it still falls on claimants to prove that the other side was liable for the accident. As such, an experienced injury attorney may accomplish this by sending letters of preservation of evidence to the involved parties immediately. This serves to protect evidence from being altered or destroyed. A lawyer will also conduct an in-depth investigation to identify all at-fault parties, work with insurers and defense counsel, and negotiate a favorable settlement agreement. If all attempts fail, the attorney will take the case to court if necessary.

Who Can Be Held Liable for a Big Rig Crash?

Commercial truck accident cases may be challenging to navigate due to the possibility of multiple liable parties. As such, it is recommended that injured parties and survivors retain legal counsel. The right attorney will work to identify all negligent parties. These may include:

  • Truck driver
  • Trucking company
  • Third-party loading company
  • Manufacturer of faulty truck parts and equipment
