A Bay Point man was killed after a motorcycle crash near an exit on Highway 4 on the night of Monday, June 21, 2021. The California Highway Patrol (CHP) reported that the incident occurred on Canal Road at Bailey Road shortly after 9:00 p.m.

Preliminary Report on the Motorcyclist Killed in the Highway 4 Motorcycle Crash

Emergency personnel was called to the scene of a motorcycle accident near the Highway 4 exit for Bailey Road, CHP officials reported. A preliminary CHP traffic report by investigators suggested that a motorcyclist reportedly traveled off the roadway while riding a 2021 Harley Davidson, struck a light pole, and was ejected off the bike.

Sadly, the rider of the motorcycle succumbed to his injuries after the collision. The Contra Costa County Coroner’s Office has recently confirmed the decedent’s identity, 31-year-old Joshua Acosta of Bay Point. Further information on the single-vehicle crash was not immediately available.

Losing Someone You Love

The sudden loss of a relative is never easy, but it can be particularly painful if it could have been prevented. While the thought of bringing a claim for a fatal motorcycle accident rarely comes at the forefront of survivor’s minds, it is essential for surviving family members to protect their rights and prevent further harm from negligent parties. This may compute into the form of economic and non-economic damages.

California law allows the immediate family of the decedent to bring a wrongful death case where their loss was caused by the recklessness or negligence of someone else. Outstanding end-of-life medical costs and funeral service bills are only some of the many financial consequences that survivors may be left facing after the unexpected death of a close relative. The family may have also been dependent on the decedent for financial support, guidance, care, companionship, services like childcare, and other contributions to the household. Who is Responsible for a Fatal Motorcycle Crash?

Based on the unique facts and circumstances of a fatal motorcycle crash, other parties may be held financially accountable for losses incurred. When a poorly designed or maintained public road is to blame for a fatal motorcycle accident, survivors may have grounds for a government entity claim. Keep in mind that such cases are subject to a short and strict filing deadline. Under California Government Code Section 911.2, surviving family members have as little as six months to bring a notice of claim against a government entity for a road defect contributing to a fatal crash.

Another potential negligent party would be the manufacturer of the motorcycle involved in the single-vehicle accident. In some cases, the products that fail in motorcycles may be related to the rear wheels, shock absorbers, and brakes. Surviving family members must be prepared for what comes with such cases.

To be successful in an auto products liability claim for a defective motorcycle, the bike must be kept and preserved until it has been examined by an experienced attorney and their team of experts. A lawyer will determine whether design, marketing, or manufacturing defects are to blame for a fatal crash. Manufacturers, like insurance companies, may resort to defense tactics to downplay the value or validity of the case. An attorney will not stand for that and protect surviving family members’ best interests. Learn how our law firm can help your family by calling us today for free, friendly case advice.
