Antioch Hit and Run Truck Accident

Accident Near Intersection in Antioch

On February 21 at about 4:29 p.m., a hit and run accident occurred near the intersection of Delta Fair Boulevard and Somersville Road in Antioch. Witnesses who called the accident into the police department dispatch reported that a big rig had passed through a red light without stopping and hit a minivan, then continued going without stopping to offer assistance. An additional witness reported that the truck was in Pittsburg, about six miles from Antioch via the California Delta Highway, but had turned the truck around, driving back toward Antioch.

Hit and Run Driver Apprehended

The truck was located by police traveling east along Buchanan Road. The officer who located the truck then watched as it rear-ended an additional vehicle before being forced to stop. The truck driver, 34, was taken into custody by local law enforcement officials and discovered to be under the influence of alcohol. No injuries were reported in the accidents, and no further information has been released about the truck driver as of the date of this report.

Accidents Involving a Hit and Run

In the above case, the hit and run involved a man who was later arrested. California law mandates that a driver who is involved in an accident, even if it does not result in an injury, stop and leave a note and take down the other vehicle’s license plate number. While charges against the truck driver have not yet been released, they will most likely consist of some form of DUI charge, a traffic law violation for running the red light and leaving the scene of an accident, not only once, but twice. The question most vehicle owners have in this type of situation is how they can recover damages for their vehicles.

Recovering Damages From a Hit and Run Driver

Personal injury cases involve the ability to prove negligence in order to receive compensation. A driver who violates traffic laws and is found to have consumed alcoholic beverages before the accident shows that he or she did not act in a responsible manner. This would prove negligence under California Evidence Code 669, or failure to exercise due caution. A conviction under these charges would prove the case for negligence in court.

Reasons Why A Big Rig Driver Might Commit a Hit and Run

The trucking industry, along with the state of California, are stringent when it comes to reckless driving, and violations. Whether these violations are small or large, they can prevent a driver from working or being licensed. It can also result in fines, and in more serious cases, incarceration. In some cases, reckless driving may be caused by:

  • Illegally operating a big truck outside regulated trucking hours
  • Consuming alcoholic beverages or drugs
  • Driving on a suspended license
  • Traffic law violations such as speeding or running a red light
  • Distracted driving
