Importance of Seeking Medical Treatment After a Car Accident

After a motor vehicle accident, it is often necessary to receive medical care to recover from injuries suffered in the incident. This may consist of hospitalization, surgery, adaptive medical devices, primary care visits, physical therapy, prescription medications, and a wide array of other methods for treatment. What is unfortunate is that medical treatment is not free, and costs may incur, even if there is health insurance.

Any person that is hurt in a car crash caused by a negligent driver or entity should not be responsible for paying bills for accident-related medical treatment. California recognizes this and provides injured parties a way of recovering compensation for economic and non-economic damages through a personal injury claim. These types of claims are generally filed against insurance companies representing negligent drivers. In other situations, they may be covered under a first-party insurance claim through uninsured and underinsured motorist coverage (UM and UIM) if the at-fault party has insufficient or no bodily injury liability coverage.

Keep in mind that it is essential to follow orders from physicians for accident-related medical treatment. You should avoid missing too many appointments or rescheduling them. The auto insurance company may take gaps in treatment as you are no longer hurt. However, it is the job of an experienced injury lawyer to recover resulting damages that can be proven. Types of Compensation in a Car Accident Case

A personal injury claim with any insurance company should not be handled on your own. Insurers handling bodily injury claims are not in the business of offering fair compensation for damages incurred, even if they are your insurance company too. The types of compensation in a car accident case may include the following economic and non-economic damages:

  • Medical expenses
  • Lost wages
  • Pain and suffering
  • Emotional distress and mental anguish
  • Any out-of-pocket costs related to the accident

Do not attempt to settle any bodily injury claim just because the insurer is pushing you to do so. You should work with an experienced attorney to ensure that you receive fair compensation for all resulting losses. Once you settle, there is no way of seeking additional compensation, so make sure you speak with a lawyer so your losses are considered and covered.
