Losing a Loved One in a Drunk Driving Accident

Losing a loved one in an accident in Arden-Arcade is difficult enough for the family that has to cope with the grief of their loss. It’s even worse when the death was caused by a drunk driver. By filing a wrongful death claim, the family can recover compensation for their loss, which helps them avoid financial problems and offers them justice and closure.

Those Eligible to File a Wrongful Death Claim

Normally, the decedent’s spouse and children or the administrator of the estate file the claim. If the decedent had no spouse or children, then the parents and siblings can file a wrongful death claim. However, only one claim is allowed.

  • If a negligent driver causes a fatal accident, the family may recover the following by filing a wrongful death claim:
  • The deceased person’s wages and benefits up to their retirement age.
  • Funeral and other end-of-life expenses.
  • Compensation for the spouse for the loss of love, moral support, and companionship.
  • Support for the decedent’s children.
  • Inheritance losses in some cases.
  • The cost of household assistance covers tasks the decedent used to perform, such as tax preparation, yard maintenance, auto maintenance, cleaning, cooking, and other household chores.
  • When egregious or especially reckless negligence caused someone’s death, the family may be able to ask for punitive damages. Damages awarded are usually 1.5 to 5 percent higher than their other compensation and in addition to it.
