Intersection of West Elkhorn and East Levee Site of Accident Fatality

An accident fatality occurred near North Natomas on August 3 in a single-vehicle crash. The California Highway Patrol (CHP) reported that the accident happened around 11:45 p.m. along West Elkhorn Boulevard where it intersects with East Levee Road. Initially, it was thought there were no major injuries from the accident, so only one Sacramento Fire Department truck was sent.

Passenger Fatality Discovered Inside the Vehicle

Three people suffered minor injuries; however, a deceased person was discovered inside the vehicle. The firefighters had to use spreaders to open the car doors and extricate that individual. The driver of the vehicle submitted to a field sobriety test, where it was determined that he had been driving drunk. Traffic was blocked between East Levee and Sorento Roads, while an investigation was conducted by authorities.

Losing a Loved One in an Accident Fatality

Losing a loved one is never easy. However, when the person’s demise is due to another’s negligence, it is all the more traumatic. The family experiences a range of emotions, including grief, anger, and the need for justice. Since their loved one can no longer fight for themselves, the family must do it for them.

AutoAccident.com, a leading law firm in Sacramento, California, believes that seeking justice for a family member is the right thing to do. Ed Smith, the owner and founder of the firm, has been helping families for the past 38 years do just that. Ed knows the financial burden the loss of support a family faces when a wrongful death occurs is frightening. He works hand-in-hand with his investigators to find out why the decedent died and give the family a sense of closure while helping them obtain financial compensation.

Who Can File a Claim Against a Drunk Driver?

Anyone who is injured by a drunk driver can file a lawsuit against them. This includes passengers in the same vehicle. If one of the passengers dies as a result of the drunk driver’s negligence, the family can place a wrongful death claim against the driver.

How an Accident Is Investigated

The collection of evidence is necessary to find out how an accident occurred and assign fault. It is also important if a loved one is lost or injured due to someone else’s negligent actions. By proving fault, an injured person or grieving family can claim compensation. Some ways an accident is investigated include:

  • Talking to witnesses who saw the accident
  • Obtaining video from traffic surveillance cameras and cell phones to see the accident in real-time
  • Looking for vehicular defects such as defective tires and brakes that may have caused the crash
  • Reviewing police reports that are used in insurance company negotiations and in court for mistakes
  • Checking to see if the driver was taking a medication that led to the accident fatality
  • Using accident reconstruction techniques to determine how the accident fatality happened
  • Evaluating pavement marks are instrumental in understanding why the accident fatality happened
  • Determining if the driver tried to brake before hitting an obstacle
