Accident on Black Bart Avenue Intersection Proves Fatal

A motorcycle crash killed a rider in South Lake Tahoe on July 20 when he was involved in an accident with a pickup truck. The accident happened at the Black Bart and Hank Monk Avenue intersection around 6:48 a.m., as reported by the California Highway Patrol (CHP). The rider, on a Yamaha motorcycle, was heading north along Black Bart Avenue when a motorist in a Toyota pickup made a left turn off Hank Monk Avenue, which caused the motorcycle to crash into the truck’s side.

Fatal Motorcycle Crash Being Investigated to Determine Fault

The rider of the motorcycle was taken to the hospital in South Lake Tahoe, where he died from his injuries. The motorcycle rider who died was identified as age 47. The pickup driver was treated at the same hospital for minor injuries suffered in the crash. The CHP investigation into the cause of the fatal collision is ongoing.

Filing a Wrongful Death Claim in California

Immediate family or the administrator of the estate can file a wrongful death claim in California. However, only one lawsuit is allowed, so it has to be decided whether the estate administrator or family members themselves will do it. Immediate family members refers to the spouse or putative spouse and children of the person who died.

Children can be natural or adopted, and stepchildren may be included in the claim if they obtained at least half their financial support from the deceased. If the deceased was unmarried and had no children, other family members may file such as the parents and siblings.

The Fight Against Negative Views of Motorcyclists

Insurers often make negative comments toward motorcycle riders in an effort to make them out as irresponsible to lessen their liability, so it is important to hire an accident attorney with experience in combating those remarks. In addition, if a case goes to civil court, juries are sometimes badly misinformed about motorcyclists, which can affect the outcome. Knowing how to combat this information is important, so educating the jurors can make a big difference.
