Negligent Actions by a Motorist That Can Lead to a Pedestrian Injury Accident
Negligent driver actions that frequently cause pedestrian injury accidents include distracted driving, speeding, failure to yield, running red lights or stop signs, and impaired driving.
Common Forms of Motorist Negligence
- Distracted driving, such as texting, talking on the phone, or adjusting in-car controls, diverts a driver’s attention from pedestrians and traffic.
- Speeding reduces reaction time and increases the risk and severity of pedestrian crashes, especially in crosswalks, intersections, and school zones.
- Failing to yield the right of way at marked or unmarked crosswalks is a common cause of collisions, as California law generally requires drivers to stop for pedestrians crossing streets.
- Running red lights or stop signs puts crossing pedestrians at severe risk.
- Driving while intoxicated with alcohol or drugs impairs a driver’s judgment, reaction time, and coordination, leading to more pedestrian incidents and more severe outcomes.
- Making illegal or careless turns, particularly left-hand turns at intersections, often leads to pedestrian impacts as drivers may not notice people crossing.
- Disregarding traffic signals, failing to check for pedestrians when turning, backing up without caution, or driving carelessly in low-light or poor weather conditions also contribute to pedestrian injuries.
Typical Damages Recoverable in Pedestrian Injury Claims
Typical damages recoverable in pedestrian injury claims include both economic and non-economic losses. Typical damages can cover all medical expenses, past and future, as well as lost wages, and reduced earning capacity. Additional damages often include pain and suffering, emotional distress, loss of enjoyment of life, and disfigurement or disability.
