What Is Elder Sexual Abuse?

It is a form of elder abuse, which is defined as an act, or lack of necessary action occurring within any relationship where there is an expectation of trust. This activity causes harm or anxiety to an older person. Sexual abuse of elders can take many different forms, including rape, sexual harassment and exploitation.

Elder sexual assault is often perpetrated by someone with a position of power or authority over the older person, such as a family member, friend, caregiver or health care professional. In some cases, the perpetrator may be a stranger. Elder sexual abuse can occur in both institutional and home settings.

How Does Elder Sexual Abuse Affect the Older Individual?

Elder sexual abuse is a serious problem that can have lasting physical and psychological effects. Survivors of elder sexual assault may experience a wide range of emotions, including shame, fear, anger, isolation and guilt. They may also suffer from physical injuries and sexually transmitted diseases. Elder sexual abuse can also lead to financial problems.

Can a Lawsuit Be Filed Against a Nursing Home Where It Occurred?

If your loved one was injured while in the care of a nursing home, you may wonder if you can file a lawsuit against the facility. The answer to this question depends on several factors, including the type of injury sustained and the circumstances surrounding the incident.

In general, nursing homes are required to provide a certain standard of care to their residents. If they fail to do so and a resident is injured as a result, the nursing home may be held liable.

To hold a nursing home responsible for an injury, it must be shown that the facility knew or should have known about the dangerous condition that led to the traumatic event and failed to take steps to remedy the situation.

If you believe that your loved one has been injured due to the negligence of a nursing home, it is important to speak with an experienced attorney who can help you understand your legal options.
