Vehicle Crashes Near Bradshaw Road in Major Injury Accident

A major injury accident happened in Sacramento on August 5 when a sedan flipped onto its roof off the roadway. The collision occurred on Florin Road just west of Bradshaw around 5:30 p.m. The individual who reported the collision to the California Highway Patrol (CHP) said the vehicle was speeding prior to the accident when it struck a pole. When the vehicle overturned, it ended up on someone’s property.

Investigation Ongoing to Determine Major Injury Accident Cause

An anonymous caller to CHP traffic reported that the driver was struck while driving and hit the pole. Someone jerked the wheel, which caused the collision. Both of the injured parties were transported to Mercy San Juan Hospital for medical attention and evaluation. An investigation is ongoing to determine the cause.

Liability in a Case Where Both the Driver and Passenger May Have Been Negligent

The primary liability in most cases of car accidents lies with the driver. Speeding is a traffic violation and can be considered negligent behavior. If the driver was speeding and the major injury accident occurred as a result of their actions, they could be held liable for any damages or injuries that result from the crash.

The passenger’s liability would depend on the circumstances of the case and the laws of the jurisdiction in question. In some situations, a passenger who interferes with the driver’s ability to operate the vehicle safely could be considered partially or fully responsible for the accident. The passenger’s actions could be seen as contributing to the crash.

How a Lawyer Investigates an Injury Claim to Prove Liability

When a lawyer investigates an injury claim to prove liability in a major injury accident, they follow a systematic process to gather evidence and build a strong case. The lawyer meets with the injured party to gather essential information about the incident, the injuries sustained and the potential liable parties. During this meeting, the lawyer will also explain the legal process and discuss the potential for compensation.

Gathering Evidence

The lawyer will collect all relevant evidence related to the accident and injuries. This may include photographs of the accident scene, medical records, police reports, witness statements and any other documents that can help establish liability.

Accident Reconstruction and Review of the Documents

In complex cases, the lawyer may work with accident reconstruction experts to recreate the sequence of events leading to the injury. This can help establish how the accident occurred and who might be at fault. The lawyer will review any documents related to the incident, such as contracts, insurance policies, maintenance records and any other relevant paperwork.
