Three Injured in Stockton Apartment Crash

Three people, including a baby and a toddler, were injured in a Stockton apartment crash on the morning of August 18, 2019. The car accident occurred on Hammer Lane at Lan Ark Drive in Stockton. Investigators said a driver of a Dodge Ram pickup drifted off the roadway and collided with an apartment in the area. The Dodge allegedly came within inches of the family who lived in the apartment. However, none of the residents were reportedly injured. There were four parties inside the Dodge at the time of the crash, including a man, woman, baby, and toddler. Officials said the man driving the Dodge and the two children were transported to the hospital for treatment of unknown injuries. An update regarding the conditions of those injured was not immediately available.

Liability in a Stockton Apartment Crash

When a vehicle crashes into an apartment complex, there may be several types of claims that may arise in these types of accidents. These include:

  • Injured Tenants: A tenant who has been injured in an apartment car accident may be able to file a claim against the negligent driver for damages incurred. This includes reimbursement of any medical expenses, lost wages, and pain and suffering. If the crash was caused by an egregious act such as driving under the influence, the tenant may also be able to seek punitive damages against the motorist. This type of damage is not generally covered by insurance companies. Instead, it is intended to punish the at-fault party for their misconduct and deter similar behavior in the future.
  • Injured Vehicle Occupants: When passengers are involved in an apartment auto accident, they may be able to file a third-party claim against the driver of the vehicle for resulting losses. If defective vehicle equipment was the cause of the collision, then a products liability claim may be filed against the automaker and manufacturers of the faulty car parts. As with any case for auto products liability, the vehicle should be kept until it has been examined by an experienced injury lawyer.
  • Apartment Property Damage: Uninjured tenants generally cannot file a personal injury claim for damages unless they have suffered physical injuries. If property damage is only involved in an apartment car crash, the tenant may have several options for recovery. A tenant may seek reimbursement for property damage from the at-fault motorist’s insurer. If the driver did not have insurance at the time of the crash, the tenant may have recourse through their own renter’s insurance policy.

In a personal injury claim, there are specific factors that may affect the value of such cases. To learn what these are, watch the below video.

Is Hiring a Lawyer Worth It?

Car accidents involving apartment complexes may be stressful. The legal process for such cases may also be challenging to navigate since multiple parties may be found liable. This is why it is essential to hire an experienced Stockton personal injury attorney to handle your case. A lawyer can help collect critical evidence and hire crash reconstruction experts to prove liability. This way, your attorney can negotiate a favorable settlement with the insurance company for the negligent driver. If all attempts for fair compensation fail, your attorney can take your case to trial, if needed.
