Stockton Resident Injured in Highway 26 Crash

The California Highway Patrol (CHP) recently reported that two parties, one of which is a Stockton resident, were injured in a motorcycle crash on Highway 26 in the Valley Springs area. The incident occurred around 2:30 p.m. on State Route 26, just east of Double Springs Road.

Report on Highway 26 Crash and Injured Parties

A preliminary report by CHP traffic officials indicated that a 61-year-old Manteca man was riding a 2017 Harley Davidson motorcycle westbound on SR-26. At the same time, a 30-year-old Modesto man was behind the wheel of a 2020 Ford transit van approaching the opposite direction. For unknown reasons, the Manteca man reportedly lost control of his bike and veered over the double yellow lines.

Unfortunately, the left front side of the Ford collided with the motorcycle. The biker and his passenger, a 54-year-old Stockton woman, both suffered serious injuries. Both were transported via air ambulance to separate hospitals in the Modesto area. Further details on the incident were not immediately available.

What is a Personal Injury Claim?

Many Californians enjoy the freedom and excitement of riding a motorcycle on the open road. The rush is undeniable. However, potential dangers from motorcycle riders may result in serious injury. When another driver’s negligence results in bodily injury, they may be held liable for resulting damages through a personal injury claim.

Bringing a personal injury case is not a straightforward process as auto insurance companies are often difficult when it comes to providing a fair settlement for harms caused by their insured. For this reason, it is essential to work with an experienced Stockton motorcycle accident attorney to ensure you receive fair compensation for your injuries and damages incurred.

What You Should Know About Motorcycle Accident Cases

If you have been recently involved in a crash as a motorcyclist, there are specific considerations that must be made. To succeed in a personal injury case, you must be aware of the challenges that may be involved in a motorcycle accident claim. This includes:

  • Protecting Yourself from Biases Against Bikers: As one may expect, some people may believe that motorcyclists are reckless and likely to cause accidents. However, that is not always the case. Most bikers ride safely and follow the rules of the road. It is often other drivers on the road that fail to watch for motorcyclists on the road, not yielding the right of way, and turning in front of bikers.
  • Explaining Severity of Injuries: Without a doubt, motorcycle accidents are likely to result in catastrophic injuries because of the lack of protection a bike offers to riders. Conversely, proving the connection between the cause and severity of the injury is necessary for recovering fair compensation in a personal injury case. It is essential to gather medical records and retain expert witnesses to explain the injuries and justify the amount of compensation demanded from the at-fault party.
  • Overcoming Defense Tactics Insurance Companies Use: After a motorcycle accident, auto insurance companies may act quickly to dispute the value or validity of bodily injury claims. In other situations, they may outright deny financial liability in personal injury cases. For this reason, it is critical to work with an experienced Stockton personal injury lawyer early in the claims process. An injury attorney can handle communication and negotiations with the insurance carrier on the claimant’s behalf. If all attempts at a fair personal injury settlement fail, the attorney can take the case to court, if necessary.
