I would like to send my thoughts and prayers to the loved ones of Ms. Begum during their time of loss.

Common Causes of Pedestrian Accidents

Pedestrian accidents occur for a wide array of reasons. However, the majority of these accidents often happen due to a driver’s negligence. Some common motorist errors that contribute to such incidents include:

  • Distracted driving resulting from talking or texting on a cell phone, applying makeup, adjusting the radio, and other distractions
  • Driving under the influence of alcohol or drugs
  • Failure to yield the right-of-way to pedestrians at controlled and uncontrolled intersections
  • Sleep deprivation which may compromise a driver’s reaction time and vision of obstacles in the road ahead
  • Speeding

Recoverable Damages in Pedestrian Accidents

Any time motor vehicle driver negligence results in serious injuries or death to a pedestrian, the injured party or their surviving family members may be able to bring a claim to recover damages. These may include medical expenses, time lost from work, disfigurements, loss of future earning potential, and more. In cases of wrongful death, specific family members may reclaim damages for the loss of their loved one, end-of-life medical expenses, costs of a funeral and burial, and other losses. For more information about what specific damages may be recovered in a claim for wrongful death, watch the following video. Pedestrian Accidents with Uninsured or Underinsured Motorists

Sometimes, the driver’s insurance policy may be insufficient to cover the full extent of damages incurred in a pedestrian accident. In other cases, the driver may not have auto insurance at all. In these instances, an injured pedestrian or family of a decedent may be able to recover compensation under their own insurance policy so long as they have uninsured/underinsured motorist protection. This type of coverage is optional in California but is essential to have in the event of an accident with a hit and run driver, a phantom driver, or a driver who has little to no liability insurance. Conversely, this coverage may extend to other household members provided that they are not listed as excluded parties of the policy. In these types of cases, it is essential to have an experienced Stockton personal injury attorney by your side to communicate effectively with insurance companies to reach a favorable outcome on your behalf as you and your family recover from your loss.
