Stockton Car Accident On Wilson Way

Pedestrian Accident Fatally Injures Woman Near Stockton

I’m Ed Smith, a Stockton pedestrian accident lawyer. A woman was walking in northeast Stockton during the evening hours of Monday, September 25, 2017. An oncoming pickup truck struck the woman. The accident, unfortunately, claimed the life of the woman.

We extend our thoughts of sympathy to the family members of the female pedestrian who passed away in this devastating incident.

What Happened?

A 51-year-old Lodi man was driving his 2010 Chevrolet Silverado pickup truck northbound along Wilson Way in the vicinity of the Stockton Diverting Canal at approximately 8:50 am. At the same time, a woman allegedly walked into the right lane of Wilson Way. This was directly into the path of the oncoming Chevrolet. The motorist was unable to avoid striking the woman, resulting in this tragic pedestrian accident. The impact of the collision propelled the woman several feet where she landed along the left lane of Wilson Way. Sadly, the woman was reportedly struck several other times. The motorist who hit her pulled his vehicle over and contacted emergency personnel immediately.

Fatal Injuries

The woman involved in the pedestrian accident, unfortunately, succumbed to her injuries at the scene. As of this writing, authorities have not released the name of the victim, pending notification of her family members.

What Caused the Pedestrian Accident?

The exact cause of the pedestrian accident remains under investigation. An investigating agency has up to two weeks to process a Traffic Collision Report. Authorities have not yet determined whether alcohol or drugs played a role in the Stockton pedestrian accident.

Pedestrian Accident Investigations

If a pedestrian is hit by a vehicle during the nighttime hours, with no other witnesses, it may be difficult to prove liability. A motorist involved in an accident typically indicates that the pedestrian “came out of nowhere” and that they were unable to react in time to avoid the collision. Although a traffic report may take the word of the motorist, an experienced Stockton personal injury lawyer will investigate further into the matter. A good attorney will study the sequence of events leading up to the fatality. Some things to look at include whether the motorist was distracted or speeding moments before the pedestrian accident occured.  Looking at the clothing the pedestrian was wearing should be examined. Damage to the vehicle and the bodily injury suffered by the pedestrian should also be analyzed. Even the lighting in the vicinity of the collision should be taken into account. If a driver failed to see a pedestrian, poor lighting in the vicinity could have contributed to the loss of life.  Oftentimes, it will be determined that speeding or distracted driving contributed or caused an accident. This is not always the case. However, when someone has lost their life and cannot give their own version of what happened, it makes sense to have an expert investigate the fatality. An experienced attorney along with accident reconstruction experts can help to properly determine causation (fault). Contact an experienced attorney for more information.
