Filing a California Claim for Wrongful Death

If you have lost a loved one in an accident, you may be able to file a wrongful death claim as a family. To do so, you must meet specific eligibility requirements and follow the proper procedures. To be eligible to file a claim, you must be the deceased person’s immediate family.

What Is a Wrongful Death Claim?

Close family members of a person who died due to the negligence of someone else can file a claim to recover damages. To file a wrongful death claim, the following must be true:

  • The death was caused by the recklessness of another party.
  • The surviving family members have suffered financial damages as a result of the death.

How Can an Injury Lawyer Help in a Wrongful Death Case?

The process of filing a wrongful death claim can be complex and overwhelming, especially at a time when you are grieving the loss of your loved one. An experienced accident attorney can help you and ensure that your rights are protected.

A lawyer can also gather evidence to support your claim and build a strong compensation case. If you have lost a loved one due to someone else’s negligence or recklessness, contact our injury lawyers at AutoAccident.com to discuss your legal options.

Can a Hit-and-Run Driver Be Found?

Locating a fleeing driver can be difficult, but our law office has successfully located fleeing drivers over the years. First, we try to get as much information about the vehicle that fled the scene as possible. Witnesses can sometimes describe the car or license plate number, which is helpful in our search. We can also check with local businesses or residents who may have seen the accident or the car leaving the area. Additionally, we can check the police report to see what information they have. By taking these steps, we may be able to find the driver responsible for the fatal crash and hold them accountable for their actions.

Does Insurance Cover a Hit-and-Run Accident in California?

In California, all drivers are required to have liability insurance. This type of insurance covers damages to another person if you are found at fault for an accident. However, by using your underinsured/uninsured policy, your own insurance company will pay for your damages up to your limit if the at-fault driver cannot be located. If your loved one didn’t have this add-on policy but another family member does, that can be used instead. It does not change your rates in the future.
