Pedestrian Accident Injures Child Near Modesto

Pedestrian Accident Injures Child Near Modesto — A pedestrian accident in Modesto on September 27, 2018, left an 11-year-old student of Somerset Middle School with serious injuries. The accident occurred along East Rumble Road and Highgate Road at approximately 7:48 in the morning. The boy was crossing in a crosswalk when he was hit by an oncoming black Chevrolet pickup truck. The young boy reportedly suffered abrasions, contusions, and trauma to his head. It is unknown whether the child was hospitalized for his injuries.

Accident Investigation

Investigators from the Modesto Police Department have not yet determined liability in the accident. A statement from the Chevrolet driver suggested that they were blinded by the sun and were unable to see the child in time to avoid a collision. Conversely, local authorities affirmed that motorists must travel at reduced speeds with due care, especially while in school zones, when the rays of the morning sun are at that angle.

Common Injuries in Pedestrian Accidents

Since pedestrians lack physical protection against a motor vehicle in a collision, they are often left with severe or life-threatening injuries. Such catastrophic injuries can lead to extended stays at a hospital and long rehabilitation periods. Some of the common injuries in pedestrian accidents include the following:

  • Broken Bones: Fractures of the leg are most common in pedestrian accidents. However, any bone may be fractured in a collision due to the impact on the walker.
  • Spinal Cord Injury: Trauma to the spinal column can be serious and can lead to chronic pain or even permanent damage. In some cases, partial or complete paralysis may occur.
  • Traumatic Brain Injury: These are among the most devastating injuries that a pedestrian can suffer. Symptoms may include difficulty sleeping, loss of memory, slurred speech, nausea, sensory issues such as blurred vision, and more.
  • Upper Extremity Injury: This is common in pedestrian accidents and may be caused by the impact of a motor vehicle or when falling to the ground. Cuts, scrapes, abrasions and bone fractures may occur.

Pedestrian Accidents Involving Children

Children are susceptible to suffering traumatic injuries or even wrongful death in some pedestrian accidents. Due to their small size, the physical contact from a motor vehicle can cause them to travel long distances airborne before coming to a rest.

Drivers owe a higher degree of care to adolescents due to their lack of capacity to perceive and avoid dangers on the road. When a motorist fails to exercise due care, they may be held financially responsible for an accident. Contact an experienced attorney for additional information.

Who is Responsible for a Pedestrian Injury?

The pedestrian has the right of way in most cases. However, a pedestrian who jaywalks, darts into traffic, or crosses against traffic signals may be considered at fault for an accident. The extent of responsibility assigned to the pedestrian and driver may be determined from witness accounts and police reports. In cases where liability is shared, the injured pedestrian may be able to be compensated for a fraction of his or her subsequent damages.
