Oroville Rollover Accident

I’m Ed Smith, an Oroville limousine accident attorney. Shortly after 8:20 a.m. on Saturday, November 29, 2016, a limousine carrying six passengers was involved in a rollover accident at the intersection of Georgia Pacific Way and Highway 70 in Oroville.

What Happened?

The black Lincoln limousine was traveling southbound on Highway 70 when it blew through a red light and collided with a pickup truck that was preceding into the intersection on a green light. The impact from the limousine caused the pickup to overturn. The limousine veered off of the road after the initial collision and hit a lamppost prior to coming to a stop.

Who Were the Passengers in the Limousine?

There were six passengers in the limousine at the time of the accident; five of the passengers were under the age of eighteen. The passengers were all members of the same family from Oroville who were traveling to Sacramento for a birthday celebration.

What Type of Injuries?

The limousine driver and a minor passenger suffered traumatic injuries as a result of the accident; the two were transported to Enloe Medical Center in Chico by air ambulance. Four other passengers were transported to a local hospital with minor injuries by ambulance. We have learned that none of the minor children who were riding in the limousine were not wearing seat belts at the time of the collision.

What should I do if I have been in an accident involving a limousine?

It is to be expected that after any motor vehicle collision, you can easily be overwhelmed with anxiety, stress, and confusion. Take a deep breath and make sure to follow these steps and collect the information you need in order to properly protect your legal rights. If you or a loved one have been in an accident involving a shuttle, taxi, limousine, or another form of public transportation be sure to:

  • Stop and assess the situation. Take the time to determine whether those involved in the accident have sustained any injuries. Take a look at the extent of the damage and take pictures for your own records.
  • Obtain the drivers license numbers and proof of financial responsibility or insurance for all the drivers who were involved in the accident
  • Collect the limousine company Transportation Charter Permit (TCP) number. A valid TCP number is required for all charter vehicles to operate.
  • If there is any witness to the accident, it is crucial for you to obtain their names and contact numbers. Witness statements can be very beneficial for establishing who caused the accident.
  • If the police were called to the scene of the accident, make sure you request a copy of the officer’s accident report.
  • If you or a loved one sustained injuries in the accident, it is important to seek medical attention as soon as possible. When at the hospital, make sure to let medical professionals know you were involved in a vehicle accident so they know to test for possible internal injuries.
  • Contact an experienced injury attorney as soon as possible to review the evidence and facts in your case, explain your options and rights under the law, and discuss your chances for a successful personal injury claim. Who is Responsible for Limousine Accidents?

Many factors come into play when determining responsibility for a limousine accident. This is why it is so important to have an experienced limousine accident attorney on your side to identify all parties who may be responsible for the accident. Those parties may include:

  • Limousine Company: The accident could have occurred because the limousine company had a defective vehicle in their fleet or they hired unqualified mechanics or drivers. A company could be found at fault if they have failed to implement proper safety procedures.
  • Manufacturers of the Limousine: A limousine manufacturer and retailer could be found responsible for an accident caused by their placing a defective limousine on the road.
  • Owners and Drivers of Other Vehicles: If there was another vehicle involved, the owners and drivers may be held responsible for their reckless or negligent driving that causes a limousine accident. At the time of the accident if the driver was performing work duties while operating the vehicle, their employer could be held liable.
  • Limousine Maintenance Company: Often times a limousine company will contract with an independent company to maintain the limousine(s) in a safe and proper mechanical condition. A maintenance company could be found accountable for negligent maintenance that causes an accident
  • Limousine Driver: In most cases, limousine accidents are caused by negligent and reckless actions of the driver. Limousine drivers may fall asleep at the wheel, violate traffic laws, or take unnecessary risks. Drivers involved in a crash can be held personally responsible for the injuries sustained by the passengers. However, the company who employs the driver, and their insurance company, will usually be held financially responsible for injuries caused by the accident.
