What Surviving Family Members Can Expect From Cases of Wrongful Death

A crash involving a motorcyclist may be a traumatic, devastating event in an individual’s life. Results may range from a wide array of injuries or even death in some extreme cases. When a family is deprived of a loved one due to a motorcycle collision caused by someone else’s wrongdoing, they may hold that party accountable for their loss. Eligible claimants may seek reimbursement for non-economic and economic damages. Surviving family members may be compensated for mental anguish, loss of companionship, funeral service costs, medical costs (via survival action), and other relevant losses.

As with any accident case, an investigation into the matter is necessary. There are many potential causes of motorcycle crashes, and only an in-depth investigation complete with evidence will effectively help surviving family members prove liability for the incident and the resulting damages. Evidence that is useful for proving fault in these cases includes police reports, medical records of the deceased, photos of the crash site, video surveillance footage, eyewitness accounts, testimony from experts, etc. Moreover, a two-year deadline generally applies in these cases.

Every wrongful death motorcycle accident case is unique due to the facts and circumstances involved. As such, it is helpful to consult with an experienced California wrongful death attorney before discussing your situation with the insurer. Some insurance carriers may disregard a claimant’s best interests by focusing on their bottom line. Insurance companies may often offer lowball settlement amounts, deny claims, or delay the claims process. With a lawyer providing you guidance and handling your case, you can rest assured that it is in good hands.
