Taking Legal Action Through a Wrongful Death Claim

The loss of a family member in a vehicle versus motorcycle accident can be painful and devastating. If someone else is to blame for the loss of life, the family of the deceased may have grounds for a wrongful death action against the negligent party. Under the California Code of Civil Procedure Section 377.60, the decedent’s immediate family has priority for filing a case, which includes a surviving spouse, domestic partner, or child. If these relationships do not exist, other family members who were financially dependent on the deceased may be considered.

The unexpected losses that may mount after the death of a loved one may be overwhelming. This is especially true when coupled with the loss of financial support the decedent would have contributed to the household. Common economic and non-economic damages in cases of wrongful death may include funeral service costs, loss of the decedent’s financial contributions to the family’s household, loss of companionship, and mental anguish. Eligible survivors may also seek reimbursement for end-of-life treatment through a survival action.

In the case of a car versus motorcycle crash fatality, a claim for damages is generally brought against the at-fault party and their insurance provider. Given that the losses are often staggering in cases of wrongful death, there may be concerns regarding sufficient liability coverage. If the negligent party has minimal liability coverage limits, survivors may turn to the decedent’s underinsured motorist coverage for recourse. In the event that the at-fault party has no liability coverage, surviving family members may file a claim through the deceased’s uninsured motorist coverage.
