Importance of Evidence in a Personal Injury Claim for a Bicycle Accident

There must be clear evidence of losses to have a successful claim for bodily injury. To file a claim for damages from a cycling crash, there must be evidence and documentation that support the timeline for the accident and the resulting injuries. If there are gaps in treatment, the insurer may dispute the reported injuries and claim that they are not related to the bicycle accident. When the injured party does not follow orders from the treating providers, the insurance carrier may interpret this as injuries that are not as severe as reported and will dispute the claim as such.

Another defense tactic that an insurance company may use to devalue or deny a claim for damages is to dispute liability for a cycling crash. Insurance companies may shift fault onto a bicyclist in the event of a crash for failure to yield, cycling on the wrong side of the road, not stopping for posted stop signs, turning abruptly without providing a signal to others, etc. Comparative fault may be noted in such cases. This means that an injured party’s recovery would be decreased by the percentage of fault that is assigned to them.

Motorists are held to a higher standard of care for children on the road. Drivers must be vigilant of their surroundings, including children in areas where they tend to be present. Given that children are unpredictable due to their age, mental capacity, and experience, motorists must be prepared for the unexpected and exercise a greater duty of care. When a driver fails to do so and causes a cycling crash involving a minor child, they may be held liable for damages.
