Third Circuit Court Dismisses J&J’s Bankruptcy Petition

The recent decision by the Third Circuit Court has also impacted the ongoing litigation concerning talcum powder. The court’s decision to dismiss Johnson & Johnson’s appeal of their bankruptcy petition will allow for trials involving talc plaintiffs to resume. The company had filed for bankruptcy protection in order to shield itself from further claims and lawsuits related to its talcum powder products, which have allegedly been linked to numerous cases of cancer.

Why Is This Ruling So Important?

There were approximately 38,000 lawsuits Johnson & Johnson attempted to funnel into its newly formed subsidiary, LTL Management LLC, before declaring it bankrupt, a ploy that could have saved the company billions. This is often referred to as a Texas Two-Step, which is a legal maneuver. However, more than 25 studies have shown a link between using talc and developing ovarian and other cancers such as mesothelioma, and in this case, it didn’t work.

With the lawsuit now able to proceed, talc plaintiffs will once again be able to pursue their legal claims against Johnson & Johnson and seek compensation for their damages.
