Injury Accident Involving a Pedestrian Reported on Business Center Drive

A Fairfield accident involving a pedestrian on November 30 left the person on foot with critical injuries after a fleeing driver struck them. The crash was reported near the intersection of Business Center Drive and Green Valley Road around 3:07 a.m. when Fairfield Police Department officers arrived at the scene. The pedestrian sustained critical injuries and was taken to a hospital for medical care and evaluation. Business Center Drive westbound was shut down as authorities investigated the collision.

Hit-and-Run Drivers in an Accident Involving a Pedestrian

Hit-and-run drivers are often committing some act of negligence when they lose control and strike a pedestrian. In some instances, they may be intoxicated, while in others, they might be speeding, distracted or too fatigued to be behind the wheel of a car. However, if they cause an accident involving a pedestrian that results in trauma, the injured walker can file a claim against them to recover compensation, including for all of their medical expenses, pain and suffering and lost wages.

How We Locate a Fleeing Driver

Our law office has successfully located hit-and-run motorists a number of times. We do it by conducting an investigation to identify the driver and vehicle by:

  • Going to the accident scene and recovering evidence of the incident involving a pedestrian
  • Checking traffic and other surveillance cameras for footage of the collision as it occurred
  • Performing accident reconstruction to determine how the collision occurred and who was at fault
  • Reviewing the police report to determine its accuracy
  • Checking local body shops for vehicles that match the description or show signs they’ve been involved in an accident

Once the driver is located, they can be held responsible for the accident injuries by using the collected evidence to build a strong claim for compensation. However, in some cases, the driver is either uninsured or doesn’t have sufficient coverage to pay for the pedestrian’s losses. There is still another way for the injured pedestrian to recover compensation.

Using Your Uninsured/Underinsured Insurance Policy

If the fleeing driver cannot be located or it turns out they are uninsured or underinsured, your own auto insurance can be used to recover compensation. California drivers often choose to take an add-on policy that covers such incidents because there are many motorists who drive around with no insurance coverage. If you do not have an uninsured/underinsured policy but a close family member does, you can use theirs instead to recover compensation for your injuries. The rates for that policy will not increase if it is used.
