Overview of a Wrongful Death Claim for a Fatal Accident

The loss of a close relative is a tragic and painful event. There is nothing that may be done to undo the heartbreak and devastation of such a tragedy. However, holding the other side liable through a wrongful death claim may provide a family with a sense of closure and peace of mind. While no amount of money can replace a lost family member, it may help provide survivors with stability and a more secure future. If the fatal incident was a hit-and-run, recourse may include an uninsured motorist claim through the deceased’s auto insurance plan or that of a family member they lived with. Keep in mind that the decedent cannot be listed as an excluded member of the policy for this option.

Eligible surviving family members in wrongful death claims in California may seek reimbursement in the form of non-economic and economic damages. Non-economic damages are intended to compensate survivors for other types of harm that are subjective in nature and value. This may include loss of companionship and mental anguish. Economic damages are meant to reimburse the decedent’s family for quantifiable losses. This may include funeral service costs, final medical bills (recoverable through a survival action), lost income, and other financial losses.

Although surviving family members may be coping with immense stress and grief, discussing their case in detail in a free consultation with an experienced accident attorney may be their best option. This may provide some relief knowing that assistance is available and just a phone call away. A lawyer will help survivors by holding the other side liable and building a strong case for full financial compensation on their behalf.
