Wrongful Deaths and Recovering Compensation

If a driver or another entity caused your family member’s demise through negligence in a Yuba City two-vehicle accident, then you have a wrongful death case. Families (spouse/putative spouse and children) may recover compensation for wrongful death if it can be proven the other driver was negligent. The following types of damages are recoverable:

  • Funeral and burial costs are recovered from end-of-life expenses.
  • The surviving spouse can also recover compensation for benefits received in the loved one’s job until the deceased’s retirement age.
  • Loss of affection and consortium can be claimed by the surviving spouse.
  • A child who lost parental guidance or nurturing may recover damages if the deceased parent/stepparent supported them by at least 50 percent.
  • The decedent’s loss of assistance in the home, such as caring for the children, cooking, mowing the lawn, and maintaining the family vehicle, is recoverable.
  • There are some claims where compensation can be recovered for loss of inheritance.

Is it Necessary to Hire an Injury Lawyer After an Accident?

When you lose a family member in an accident in Yuba City, hire an experienced wrongful death attorney who can guide you through the legal system. A lawyer can determine which driver was responsible when two vehicles are involved. The personal injury lawyer can assist you in the process and has experience in similar cases to yours.

An accident attorney knows what compensation you should expect from your wrongful death claim because they have handled many similar accidents. It isn’t necessary to pay the lawyer’s fee upfront. Legal representation for injured people is provided by contingency fee-based attorneys who do not receive payment unless they win.

Your Claim’s Supporting Evidence

In the aftermath of your loved one’s Yuba City two-vehicle accident, a personal injury lawyer can use their investigator to help build a strong case for you. Accident reconstructionists and witness statements can be used to determine liability. A police report is also reviewed for errors, and surveillance cameras in the area are examined.
