How Wrongful Death Actions Help Surviving Family Members

When a family is deprived of a loved one due to an accident, there is not enough money in the world to make up for the pain and devastation that accompanies such a loss. Cases of wrongful death are often challenging and require in-depth investigations to ensure that all negligent parties are held accountable and grieving families receive full compensation for their damages. Recoverable losses may include loss of companionship, lost financial support, funeral costs, medical bills (recovered through a survival action), loss of household support, and more.

Specific relatives have priority for filing. California law lists the decedent’s surviving spouse, domestic partner, and children. Other relatives may be eligible to file a claim if these relationships are non-existent. This is outlined in CCP 377.60. Cases of wrongful death must be filed in court within two years of the fatal incident. This is by CCP 335.1. It is crucial that survivors act quickly and retain legal counsel who can gather evidence before it is destroyed or altered, conduct prompt investigations, negotiate with insurers, and file the case in court to proceed with litigation if necessary.

A wrongful death claim may take a few months to a few years to resolve. While some cases may settle sooner if the at-fault party agrees to specific terms and accepts liability, negligent parties with more resources may delay claims in hopes of surviving family members dropping the case. Therefore, it is best for survivors to have an experienced California wrongful death attorney from a law firm with the experience, resources, and skills to see a fatal accident through. How is the Value of a Wrongful Death Car Accident Case Determined?

The loss of a loved one may be both emotionally and financially devastating. While no amount of compensation can take the pain away, it can help surviving family members secure financial stability. The value of a case of wrongful death may depend on various factors, including the decedent’s age, health, life expectancy, education, occupation, future earning potential, amount of liability coverage available, and more. While it may be challenging to put a dollar amount on a loss of life, an attorney with the resources and experience can help ensure that survivors obtain justice and closure for their loss.
