Who is Liable for a Single-Vehicle Accident?

Single-vehicle collisions, like other types of auto accidents, often result in traumatic injuries. Driver error is often believed to be the result of these events. However, they may occur for factors outside of a motorist’s control. It will take an independent investigation by an experienced injury lawyer to determine liability on the part of a hit-and-run driver, vehicle manufacturer, or government entity:

  • Auto Manufacturer: A car accident involving one vehicle may occur because of faulty parts and equipment. While rare, a thorough investigation into the incident is necessary to determine whether defective vehicle equipment and parts played a role in the crash. Manufacturers are held to strict standards in California and may be held liable for any damages or injuries resulting from a flaw in the design, safety, and other components. The vehicle in question must be in possession and preserved in its original state following the incident. Auto products liability cases are challenging and should be left to an experienced Stockton car accident lawyer to handle.
  • Government Entity: If a single-vehicle collision was found to have occurred because of a road defect, the public agency responsible for the maintenance of safe roads may be held liable for damages incurred. This may include failing to repair large cracks, uneven pavement, and potholes in the roadway. Damaged or missing protective barriers and guardrails, lack of warning signage for dangerous curves, overgrown foliage, road debris, and poorly designed roads may also constitute negligence in such cases. Claims against government entities must be filed within 180 days from the date of loss, per California Government Code Section 911.2. Therefore, it is crucial to contact a lawyer right away for assistance.
  • Hit-and-Run: Accidents involving hit-and-run drivers have the potential to change someone’s life. Since the suspect party fled the scene without identifying themselves nor exchanging insurance information, there is always the possibility of an injured party or a decedent’s family being left to deal with unexpected costs. Fortunately, with an experienced hit-and-run accident attorney on your side, you can rest assured knowing that your lawyer will gather evidence, work with a private investigator to track down the suspect driver and work with your insurance company to bring an uninsured motorist (UM) claim for damages incurred.
