Rural Road Collisions

Rural roads often pose significant dangers that can result in accidents, leading to severe trauma or even fatalities. With less traffic and reduced police presence compared to highways, some motorists may take risks they wouldn’t consider on more traveled routes, such as speeding, driving under the influence, and engaging in other reckless behaviors.

Furthermore, since rural roads typically consist of just two lanes, drivers often need to pass slower vehicles, and the visibility of the road ahead may be limited, increasing the risk of fatal accidents on these rural routes. When a loved one tragically loses their life in a rural road accident, seeking the assistance of an accident attorney to determine liability can be crucial for surviving family members seeking to file a wrongful death claim.

The Recovery of Compensation After a Wrongful Death in the Family

If a loved one has been killed in a head-on collision or fatal rural road accident, you should be aware of your rights and options to seek compensation for their loss. You and other family members who are affected by the death may have legal recourse depending on the circumstances surrounding their death.

Cases Involving Wrongful Death

The most common basis for filing wrongful death claims is negligence, where the responsible party was expected to exercise caution to prevent harm but failed to do so. In negligence cases, the at-fault party or parties can be held liable for wrongful death, leading to the possibility of seeking monetary damages. It’s important to note that each wrongful death case is unique, and the following expenses may be recoverable for your family:

  • Funeral and burial expenses are eligible for recovery.
  • Earnings of the deceased individual can be recovered until their regular retirement age. This includes various benefits such as pensions, insurance benefits, bonuses, tips, and other sources of income they typically receive. The deceased person’s earnings can be established using tax statements and other relevant records, primarily if self-employed.
  • The deceased’s spouse may have a claim for the loss of consortium, emotional support, and love.
  • Children, including those adopted or raised by the decedent, may have grounds to file a claim for the loss of parental guidance, nurturing, and support.
  • Family members can also seek compensation for the loss of household help, as they may need to hire someone to perform tasks previously handled by the deceased. Financial reimbursement may be available for lawn maintenance, vehicle upkeep, childcare, tax preparation, and more.
  • In some cases, compensation may be available for the loss of inheritance.

In your wrongful death case, please consult a legal professional to understand the details and eligibility criteria for these recoverable expenses.
