Fatal Pedestrian Crash on Pacific Avenue in Stockton

The Stockton Police Department (Stockton PD) reported a fatal pedestrian crash at the Miracle Mile Entertainment District on Pacific Avenue on the night of Thursday, August 19, 2021. The incident occurred near the Ave on the Mile restaurant and bar at W Adams Street and Pacific Avenue.

Details on the Fatal Pedestrian Crash Reported on Pacific Avenue in Stockton

An employee of the restaurant, 23-year-old Casey Bynum, was taking pictures of classic cars cruising down Miracle Mile Entertainment District. While doing so, a speeding truck came within his path and allegedly crashed into him. Sadly, he succumbed to his injuries at the scene. A GoFundMe page has been created on behalf of Mr. Bynum and his family.

The owner of the Ave on the Mile restaurant and bar is asking for the City of Stockton to make street improvements after the fatal incident. The owner has said that reckless driving and speeding are ongoing issues in the area. To make the street safer for everyone, the owner wants a lighted crosswalk and curb extensions outside the restaurant in addition to replacements of the old street reflectors and the existing crosswalk to be repainted.

The City of Stockton has made a public statement regarding the discussions of traffic and pedestrian safety at the Miracle Mile Entertainment District. The entity is aware of the issue and will work to determine what changes should be implemented throughout the city, including Miracle Mile. Additional information on the pedestrian accident has not yet been released due to ongoing investigation.

What You Should Know About Fatal Pedestrian Accidents and Wrongful Death Claims

In most situations, pedestrians have the right-of-way over motor vehicles on the roads in Stockton. When a driver fails to follow the rules of the road and causes a fatal pedestrian accident, the family of the decedent may seek financial recovery for economic and non-economic damages. Economic damages are intended to compensate survivors for financial losses suffered because of unexpected death in the family. Conversely, non-economic damages provide compensation for surviving family members of the subjective and intangible harm arising from their loss. In a wrongful death claim, the following may be recovered:

  • Medical expenses such as emergency transportation, hospital stays, surgeries, and other treatment for the final injury suffered by the decedent
  • Costs of funeral and burial services may be recovered by the surviving family member who paid for them
  • Lost future financial support
  • Loss of companionship

After a fatal motor vehicle accident, an insurance company may contact the deceased person’s family to make a quick settlement offer. What families should keep in mind is that any initial settlement offer from the insurer will be far less than what they need to cover all losses they have endured. Allow an experienced Stockton wrongful death attorney to go over the facts and circumstances of the case and explain your potential rights as a surviving family member. Why is it Important to Work with a Wrongful Death Lawyer?

In California, the statute of limitations on a wrongful death matter is two years from the date of the fatal incident. This is by the California Code of Civil Procedure Section 335.1. A shorter deadline may apply if the city is also to blame for the accident. Keep in mind that bringing a notice of claim against a government entity for a road defect or other factor contributing to a crash may be a challenging process. It often requires special procedures with different filing criteria and time limits. That is why it is essential to retain legal counsel right away if you have lost someone you love in a fatal motor vehicle collision.
