What is Wrongful Death?

California law defines wrongful death as the loss of life occurring from another party’s negligent actions. There are many accidents where negligence may constitute wrongful death. Motor vehicle collisions are common examples of wrongful death. The recovery process in such a situation generally involves filing a claim against the negligent driver and their insurance company. Surviving family members may find themselves in a financial predicament if it is determined that the other side has limited liability coverage or no auto insurance. Under these circumstances, survivors may have grounds for a claim through their loved one’s uninsured and underinsured motorist coverage. What is most beneficial about UM and UIM is that protection may be extended to other family members in a household so long as they are not excluded from the auto insurance plan.

The wrongful death claims process may seem challenging and daunting, to say the least. However, financial recovery from this type of case may be crucial to maintaining a standard of living for surviving family members. This is especially true if the deceased was the primary provider of the household. Eligible survivors may seek reimbursement for economic and non-economic damages. This may include loss of future financial support, funeral costs, mental anguish, loss of companionship, and more. CCP 377.60 outlines that close relatives have priority in these cases, including the children, domestic partner, or spouse. Is There a Statute of Limitations on Wrongful Death Matters?

Per CCP 335.1, survivors have up to two years to file in civil court. While this may seem like ample time, you owe it to yourself and your family to discuss your case in detail with an experienced accident attorney. Building a case requires substantial time and effort, followed by experience, skills, and resources only a seasoned lawyer will have. Waiting too long and filing a lawsuit after the deadline may result in the court dismissing the matter and losing the right to seek compensation. Therefore, it is essential to retain legal counsel who can work to ensure that the statute is protected in your case.
