What Families Should Know About Wrongful Death Claims

The loss of a close relative is a devastating event despite the circumstances. However, when a loved one has lost their life in an accident because of someone else’s negligent or reckless actions, surviving family members have the right under California law to seek financial compensation for their loss. This process generally involves bringing a wrongful death claim against the at-fault party and their insurance carrier. In fatal pedestrian accident cases, a family may have other options for recovery when the other party has insufficient or no liability coverage, such as bringing an uninsured and underinsured motorist coverage (UM and UIM) claim. While no jury award or insurance settlement may be enough to ease the grief surviving family members may be experiencing, compensation may help them overcome the financial hardship that is related to the sudden loss of a loved one.

A wrongful death action is often a challenging matter, to say the least. Given the high stakes involved, negligent parties and insurance companies are more likely to dispute the case. For this reason, it is essential to secure a successful outcome with the assistance of an experienced accident attorney. When survivors retain legal counsel, they can rest assured knowing that their lawyer will get to work by conducting an independent investigation of the incident, collecting crucial evidence, interviewing witnesses, establishing the facts of the case, and identifying liable parties. A Turlock wrongful death attorney will also work with surviving family members to determine the emotional and financial impact they have suffered because of their loved one’s passing. How Much Time Do You Have to Bring a Wrongful Death Lawsuit in California?

A wrongful death case for a fatal pedestrian accident in California generally must be filed in civil court within two years of the incident date. This is by the California Code of Civil Procedure Section 335.1. Once the time limit has expired, the case may be dismissed, and the right to compensatory damages may be lost. This strict deadline is one of the many reasons why surviving family members should retain legal counsel after the loss of a loved one in an accident caused by negligence.
