Who is Liable for a Solo Motorcycle Crash?

Not all motorcycle accidents are the result of rider error. It is worth noting that other parties and entities may be held liable under certain circumstances. Some potential defendants in a solo motorcycle collision may include but are not limited to:

  • Vehicle Manufacturer: Not all products are safe for consumer use, and motor vehicles are no exception. If a defect in a motorcycle, like faulty steering or brakes, contributed to a crash, the manufacturer of the bike may be held liable for damages incurred. This is accomplished through filing an auto products liability claim against the manufacturer to seek reimbursement for the resulting losses. Keep in mind that the defective motorcycle must be kept and preserved in its original condition. An attorney and their team of experts will examine the bike and determine if faulty equipment contributed to the crash.
  • Public Agencies: If a solo motorcycle crash was caused by unsafe roadway conditions, the government entity responsible for the design and upkeep of the public road may bear liability for the incident. Common roadway defects include inadequate warning signage, potholes, objects on the road like fallen trees, and uneven pavement. These and other unsafe road conditions may lead to the loss of control of a vehicle and potentially a traffic collision. A different statute of limitations applies in cases against the government. Claimants generally have up to 180 days to file a notice of claim.

Establishing liability in a solo motorcycle collision may be challenging and often requires an in-depth investigation of the circumstances surrounding the incident. Consulting with a skilled injury attorney can provide useful information for your situation. Do not delay, and contact an experienced lawyer today.
